Terms of service

Effective date: 1 June 2026

These Terms of Service ("Terms") govern your use of fromthemist.in (the "Site") and any purchase you make from From the Mist ("From the Mist", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under the Indian Contract Act, 1872. By placing an order, you confirm you meet these requirements.

2. Service area

We currently ship only within India. Orders to addresses outside India are not accepted.

3. Products

We sell single-origin Reed avocados grown on our farm in the Palani Hills, Kodaikanal, Tamil Nadu. Product availability is seasonal and depends on harvest. Listings show fresh produce; weights, sizes, and ripeness windows are approximate and subject to natural variation.

Photographs are representative. Actual fruit may vary in appearance, size, and exact colour.

4. Pricing

  • All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
  • Shipping charges are shown at checkout.
  • We may change prices at any time before you place an order. Once an order is confirmed, the price for that order is fixed.

5. Orders and acceptance

Your order is an offer to buy. We may accept or decline any order at our discretion, including (without limitation) where:

  • The product is out of stock
  • The address is outside our serviceable area
  • We suspect fraud or unauthorised use
  • The listed price was incorrect due to a typographical error

A contract forms only when we send an order-confirmation email. If we decline, we refund any amount charged.

6. Payment

Payments are processed by our payment provider. By submitting payment information, you confirm you are authorised to use that payment method. We do not store full card details.

7. Shipping, delivery, cancellation, refunds

See our Shipping Policy, Cancellation Policy, and Refund Policy. They are incorporated into these Terms.

8. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose
  • Resell our products without prior written consent
  • Reverse-engineer, scrape, or copy any part of the Site beyond normal browsing
  • Upload content that is defamatory, obscene, infringing, or violates any applicable law
  • Interfere with the Site's security or operation

We may suspend or terminate your access at our discretion.

9. Account

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

10. Intellectual property

All content on the Site — text, images, logos, design — is owned by us or our licensors and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, or create derivative works without written permission, except for personal, non-commercial browsing.

11. User content

If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with our business. You confirm you own or are authorised to grant this licence.

12. Disclaimers

The Site and products are provided "as is". To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Fresh produce is perishable; storage and handling after delivery are your responsibility.

If you have any food allergy or medical condition, consult a qualified professional before consuming our products.

13. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to these Terms or your purchase is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, or consequential losses.

Nothing in these Terms limits liability that cannot be limited under Indian law (including liability for death or personal injury caused by negligence and for fraud).

14. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

15. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, weather, crop failure, strikes, courier delays, government action, or pandemics.

16. Termination

We may suspend or terminate your access to the Site at any time without notice for any breach of these Terms. Sections that by their nature should survive termination (intellectual property, limitation of liability, indemnity, governing law) survive.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the dispute resolution clause below, courts at Chennai have exclusive jurisdiction.

18. Dispute resolution

Consumers retain rights under the Consumer Protection Act, 2019 and may approach the appropriate consumer forum.

19. Changes

We may update these Terms at any time. Continued use of the Site after changes are posted means you accept them.
